Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Chuck's Academy at https://www.chucksacademy.com, including its learning portal, AI-generated paths, questions, evaluations, and related features (the “Service”).
1. Accepting these Terms
By creating an account or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you confirm that you have authority to bind that organization.
2. Eligibility and your account
You must have legal capacity to accept these Terms or use the Service with permission and supervision from a parent or legal guardian. You must provide accurate account information, keep your authentication method secure, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law.
3. What the Service provides
Chuck's Academy helps individuals prepare for programming interviews and develop career skills. It can create personalized learning paths and content maps, establish a baseline, generate adaptive questions, analyze answers, recommend external resources, and track evidence and progress.
The Service does not execute submitted code. AI reviews the text and code you provide. It does not replace a compiler, test runner, security review, teacher, recruiter, employer, or professional adviser.
4. AI content and limitations
Questions, topic maps, scores, reference answers, feedback, summaries, documentation links, and recommendations may be created or analyzed by artificial intelligence. AI output may be inaccurate, incomplete, outdated, inconsistent, or unsuitable for your circumstances.
You are responsible for evaluating output before relying on it. Use official documentation and your own judgment, particularly for security, production code, employment decisions, or other high-impact uses. You can challenge an evaluation or report content, but this does not guarantee a particular outcome.
Scores, mastery, confidence, and progress are internal learning estimates. They are not accredited qualifications, verified certifications, employer assessments, or promises that you will pass an interview, receive an offer, obtain a promotion, or achieve a particular salary.
5. Credits, charges, and future purchases
The Service uses credits to make AI usage predictable. Unless the interface clearly states otherwise, one credit is deducted when a new question is successfully generated. That charge covers the question, its reference answer and documentation, evaluation of your submitted answer, and available challenge or reporting tools. Choosing “I don't know yet” after generation does not reverse the generation charge.
Promotional or free credits may expire, be limited, or be withdrawn in cases of abuse, as disclosed when granted. Credits have no cash value, cannot be transferred between users, and cannot be resold.
If paid credits become available, the price, quantity, taxes, and material conditions will be shown before purchase. Refunds and cancellation rights will follow the terms presented at purchase and any non-waivable consumer-protection law. We will not reduce an already-purchased balance solely because we later change pricing.
6. Your content
You retain ownership of the goals, answers, code, challenges, and other content you submit (“User Content”). You grant Chuck's Academy a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display to you, and create technical or analytical derivatives of User Content only as reasonably needed to provide, secure, maintain, and improve the Service.
You confirm that you have the rights needed to submit User Content and that processing it as described will not violate law, confidentiality duties, intellectual-property rights, or another person's rights. Do not submit personal data, credentials, proprietary employer code, confidential interview material, or secrets you are not authorized to share.
7. Acceptable use
You may not use the Service to:
- Break the law, infringe rights, or violate confidentiality or employment obligations.
- Generate, submit, or distribute malware, stolen credentials, or instructions primarily intended to harm systems or people.
- Probe, disrupt, overload, bypass, or gain unauthorized access to the Service or another account.
- Automate scraping, bulk account creation, credit abuse, resale, or extraction of the Service's content or models without written permission.
- Misrepresent AI output or Academy scores as an accredited certification or official employer evaluation.
- Use another person's identity or account, or help others evade a suspension or usage limit.
8. Third-party services and resources
The Service relies on providers such as Clerk, MongoDB, and OpenAI and may link to external documentation, articles, courses, or videos. Third-party services have their own terms, availability, and privacy practices. We do not control and are not responsible for external content, and a link does not guarantee endorsement, accuracy, or continued availability.
9. Chuck's Academy property
The Service, brand, interface, software, designs, and content we provide—excluding User Content and third-party material—are owned by Chuck's Academy or its licensors and protected by applicable law. These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for your own learning and interview preparation. No other rights are granted.
10. Availability and changes
We may maintain, modify, add, remove, or discontinue features and may impose reasonable usage or security limits. We aim to keep the Service available but do not promise uninterrupted, error-free, or permanent access. We will provide notice when required by law and avoid materially depriving users of paid benefits without an appropriate remedy.
11. Suspension, termination, and deletion
You may stop using the Service at any time. We may restrict or suspend access when reasonably necessary for security, legal compliance, nonpayment, abuse, a material breach of these Terms, or protection of the Service and other users. Where appropriate, we will give notice and a chance to address the issue.
Deleting your Clerk sign-in account disables your Academy access but may not immediately delete learning history. Follow the deletion process in the Privacy Policy to request removal of eligible Academy data. Provisions that by their nature should survive termination—including ownership, accrued payment obligations, disclaimers, and liability limitations—will survive.
12. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” We do not make warranties about accuracy, completeness, fitness for a particular purpose, interview or career results, compatibility, security, or uninterrupted availability. Nothing in these Terms excludes warranties or rights that cannot legally be excluded, including mandatory consumer rights.
13. Limitation of liability
To the maximum extent permitted by law, Chuck's Academy will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of or inability to use the Service, reliance on AI output, external resources, or loss of data. Any aggregate liability for a claim will not exceed the amount you paid to Chuck's Academy for the Service during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot be limited.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Argentina, without limiting any mandatory protection available where you live. Before filing a formal claim, please contact us so we can try to resolve it. Any dispute that cannot be resolved will be submitted to the competent courts determined by applicable law. Nothing here restricts a consumer's right to use an available consumer-protection authority or process.
15. Changes and contact
We may update these Terms to reflect changes to the Service, law, security, or business practices. We will post the updated version with a new effective date and provide additional notice when required. Continuing to use the Service after updated Terms take effect means you accept them, to the extent permitted by law.
